1. Acceptance of Terms

By accessing AuraMetrics.io (the "Service"), you enter into a legally binding agreement with AuraMetrics.io ("we", "us"). If you do not agree to these Terms, you must cease use of the Service immediately.

Definition of Service: "Service" means the AuraMetrics.io platform, website, tools, APIs, analytics systems, dashboards, and related services.

2. Description of Service & AI Nature

AuraMetrics.io is a SaaS platform providing AI visibility, analytics, and GEO optimization tools.

AI Disclaimer: You acknowledge that the Service uses probabilistic AI models. Recommendations are based on current data patterns and do not guarantee specific outcomes, search rankings, traffic, or revenue.

User Responsibility: You are solely responsible for reviewing and validating any AI-generated insights, analyses, or recommendations before implementation.

3. Google API & Third-Party Data

Our Service integrates with Google API Services (including Google Analytics and Search Console).

Compliance: Your use of these integrations is subject to the Google API Services User Data Policy.

Data Usage: We access Google data in read-only mode to analyze metrics, detect tracking issues, and generate insights within the platform. We do not sell or share Google user data with third parties.

Third-Party Dependency: AuraMetrics.io is not responsible for changes, interruptions, or inaccuracies originating from third-party systems (e.g., Google core updates or AI model changes).

4. Subscriptions, Billing & Refunds

Automatic Renewal: Subscriptions renew automatically unless cancelled via account settings at least 24 hours before the renewal date.

Taxes: Applicable taxes may apply based on your jurisdiction.

Refund Eligibility: To prevent abuse, refunds are evaluated case-by-case and only considered if:

• The request is made within 48 hours of the initial purchase
• The user has consumed less than 5% of the credits included in the plan

EU/EEA Rights: Consumers in the EU/EEA acknowledge that by logging into the platform and accessing premium features, they waive their 14-day right of withdrawal, as the Service involves the immediate provision of digital content.

5. Domains, Credits & Deletion

Analysis Credits: Each plan includes a fixed number of analysis credits per domain per month. Unused credits do not accumulate or transfer between months.

Domain Deletion: You may delete up to 3 domains per calendar month. Deleting a domain permanently removes all reports, history, and associated data from all modules. This action is irreversible.

Non-Refundable Credits: Credits already consumed on a deleted domain are not restored. If you re-add the same domain within the same month, previously used credits are deducted from your monthly allowance.

6. Intellectual Property & Marketing

Our Property: AuraMetrics.io owns all software, proprietary algorithms (including GEO scoring models), and trademarks.

Aggregated Insights: You grant us a license to use anonymized and aggregated data to improve our machine learning models. This data cannot identify you personally.

Publicity: Unless you notify us otherwise at hello@aurametrics.io, you grant AuraMetrics.io a non-exclusive license to use your company name and logo on our website and marketing materials solely to identify you as a customer.

7. Acceptable Use & Security

You agree not to:

• Reverse engineer, scrape, or extract data using automated systems (bots)
• Interfere with or disrupt the infrastructure or performance of the Service
• Share account credentials or resell the Service without written consent
• Use the Service to process sensitive personal data (e.g., health or financial records)

8. Account Suspension & Termination

AuraMetrics.io reserves the right to suspend or terminate access to the Service in cases of:

• Violation of these Terms
• Misuse of the Service
• Non-payment
• Security risks or abusive behavior

9. Limitation of Liability & Force Majeure

Liability Cap: Our total liability is limited to the amount paid by you during the 12 months preceding the claim.

No Indirect Damages: We are not liable for indirect damages, loss of profits, loss of data, business interruption, or damages resulting from third-party algorithm changes.

Force Majeure: We are not liable for failures caused by events beyond our control, including server outages, internet infrastructure failures, or third-party platform interruptions.

10. Modifications to Terms

We will notify users of material changes via email or platform notice at least 30 days before they take effect. Continued use constitutes acceptance.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Oriental Republic of Uruguay. Any dispute shall be resolved in the courts of Paysandú. For Enterprise-level contracts, alternative jurisdiction may be agreed upon in a separate written Addendum.
